These Terms constitute a legally binding agreement between you and Cretiq ("Cretiq," "we," "us," or "our"). By accessing or using the Cretiq application, website (cretiq.io), or any related services (collectively, the "Services"), you confirm that you are at least 13 years of age (or 16 in the EEA), that you have read and understood these Terms, and that you agree to be bound by them.

You may not create an account on behalf of another person without their authorization, or create multiple accounts to circumvent restrictions.
Cretiq offers the following subscription tiers: Apprentice (free), Mastery (monthly), and Sovereign (annual). Features available at each tier are described on our pricing page and within the app.
Paid subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you authorize the applicable platform to charge your payment method on a recurring basis at the then-current subscription price. All prices are in USD unless otherwise stated.
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Cancellation must be made through your Apple ID or Google Play account settings — not through the Cretiq app directly.
If we offer a free trial, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.
All refund requests for in-app purchases are handled by Apple or Google according to their respective refund policies. Cretiq does not process refunds directly for purchases made through app stores. For direct purchases (if applicable), please contact [email protected].
We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase. Continued use after a price change constitutes acceptance of the new price.
Subject to these Terms, Cretiq grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.

All content within the Services — including but not limited to text, audio recordings, vocabulary content, lesson materials, frameworks, graphics, logos, software, and the Cretiq brand — is owned by or licensed to Cretiq and is protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms grants you any right to use Cretiq's trademarks, logos, or brand elements without our prior written consent.

Certain features of Cretiq (including Sovereign Council, Situation Room, Argument Forge, and Verbal Combat) use artificial intelligence to generate responses. You acknowledge that:
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Cretiq does not warrant that: (a) the Services will be uninterrupted, timely, secure, or error-free; (b) the results obtained from use of the Services will be accurate or reliable; or (c) any errors in the Services will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRETIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.
IN NO EVENT SHALL CRETIQ'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO CRETIQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Cretiq and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
We may terminate or suspend your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the public.
You may terminate your account at any time by deleting it within the app (Settings → Account → Delete Account) or by contacting [email protected]. Termination does not entitle you to a refund of any prepaid subscription fees.
These Terms are governed by the laws of the State of [State], United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by sending an in-app notification or email. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
